ProntoCab – Terms of Use
1. Contractual Relationship

Agreement: These Terms of Use (“Terms”) govern your access or use of ProntoCab’s applications, websites, content, products, and services (“Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Supplemental Terms: Additional terms may apply to certain Services and will be disclosed to you. In case of conflict, supplemental terms prevail.

Information Sharing: ProntoCab may share your information with claims processors or insurers if necessary to resolve disputes or complaints.
2. The Services

Service Description: ProntoCab provides a technology platform to arrange transportation with independent third-party providers. Services are for personal, non-commercial use unless otherwise agreed.

License: You receive a limited, non-exclusive, revocable license to use the Services for personal use.

Restrictions:
- No removal of copyright or proprietary notices.
- No reproduction, modification, or distribution except as permitted.
- No reverse engineering or unauthorized access.

Third Party Content: Services may include third-party content. ProntoCab is not responsible for such content.

Ownership: All rights remain with ProntoCab or its licensors.
3. Your Use of the Services

User Accounts: You must be at least 18 years old to register. Keep your account information accurate and secure.

User Conduct:
- No unlawful or hazardous materials.
- No smoking, alcohol, or narcotics.
- Follow all applicable laws and ProntoCab policies.

Non-Discrimination: ProntoCab does not discriminate based on religion, caste, gender, or age.

Text Messaging: By creating an account, you agree to receive SMS messages for service purposes.

Promotional Codes: Promo codes are subject to specific terms and may be disabled at any time.

User Content: You grant ProntoCab a license to use content you submit. Do not submit unlawful or offensive content.

Network Access: You are responsible for your own device and data charges.
4. Payment

Charges: You may be charged for services received. Charges are final and non-refundable unless otherwise determined by ProntoCab.

Payment: Payment is due immediately and facilitated by ProntoCab.

Price Changes: ProntoCab may change charges at any time. Charges may increase during high demand.

Cancellation: You may cancel before confirmation/advance payment. Advance paid is non-refundable and cancellation fees may apply.

Tips: Gratuities are voluntary.

Extra Charges: You are responsible for tolls, parking, and state taxes not included in the trip package.

Trip Shortening: No reduction in price if you shorten your trip.

Repair or Cleaning Fees: You are responsible for damages or cleaning beyond normal wear and tear.

Pets: Additional charges apply for traveling with pets.

Sales Partner Commission: Commission is paid only for completed trips and after minimum withdrawal limit is reached.
5. Disclaimers; Limitation of Liability; Indemnity

Disclaimer: Services are provided “as is”. ProntoCab makes no warranties regarding reliability, quality, or availability.

Limitation of Liability: ProntoCab is not liable for indirect, incidental, or consequential damages. Maximum liability is ₹500.

Indemnity: You agree to indemnify ProntoCab against claims arising from your use of the Services or violation of these Terms.
6. Governing Law; Arbitration
These Terms are governed by Indian law. Disputes will be resolved by arbitration in New Delhi, India, after 30 days of negotiation.
7. Other Provisions

Notice: ProntoCab may notify you via email, SMS, or written communication.

Assignment: You may not assign these Terms without ProntoCab’s approval.
ProntoCab – Cancellation & Refund Policy
1. Cancellation Policy

How to Cancel: Call our 24x7 Customer Care at +91 7777 880 880 before your scheduled pickup.

Fees:
- No fee if driver/car details are not provided.
- If driver/car details are provided, advance amount is forfeited as cancellation fee.
- Drivers may cancel after 45 minutes of waiting; cancellation fee or per-minute charges may apply.
- Force majeure events: Voucher for advance amount may be issued at ProntoCab’s discretion.
2. Refund Policy
Processing: Refunds take 7–10 business days. ProntoCab is not responsible for incorrect banking details.

Vouchers: In certain cases (e.g., driver cancels, car breakdown, force majeure, itinerary changes), vouchers may be issued for future use.
Limitations: No refund or voucher if you pay the driver directly (except as invoiced). ProntoCab is not liable for third-party losses.

Misconduct: Advance may be withheld for misbehavior or misconduct with the driver.
